Terms and Conditions of Use for GuardPass
These terms and conditions ("Terms") govern your use of GuardPass by Get Licensed (referred to as the "Job Board") and the services provided through the Job Board. By accessing or using the Job Board, you agree to comply with these Terms. If you do not agree with these Terms, please refrain from using the Job Board. GuardPass reserves the right to update these terms and conditions occasionally. It is your responsibility to adhere to the updated terms and conditions and it is suggested that you check these terms and conditions each time you wish to use the job board.
1.1 By using the Job Board, you agree to provide accurate and truthful information when creating an account and submitting job listings. You are responsible for ensuring the accuracy of the information provided in your job listings.
1.2 You shall comply with all applicable laws and regulations when using the Job Board, including but not limited to employment laws, anti-discrimination laws, and intellectual property laws.
1.3 You agree to adhere to the guidelines, policies, and instructions provided by GuardPass regarding your use of the platform, including any content submission guidelines, usage restrictions, and community guidelines.
2.1 The Job Board and its content, including but not limited to text, graphics, logos, and software, are protected by intellectual property laws and are the property of GuardPass or its licensors. All rights not expressly granted are reserved.
2.2 Users are prohibited from using, copying, distributing, or reproducing any content from the Job Board without explicit authorisation from GuardPass or the respective rights holders.
3.1 Users are solely responsible for the accuracy, legality, and integrity of the information provided in job listings. You represent and warrant that you have the necessary rights and permissions to post the content on the Job Board.
3.2 Job listings must comply with all applicable laws and regulations, including those related to the Employment Rights Act 1996, Equality Act 2010 and any other applicable laws. Discriminatory, offensive, or misleading job listings are strictly prohibited.
3.3 GuardPass reserves the right to review, modify, or remove job listings and other content to ensure compliance with these Terms without prior notice or liability.
3.4 GuardPass does not endorse or guarantee the accuracy, quality, or suitability of any job listings or content posted on the Job Board. Users are responsible for conducting their own due diligence and making informed decisions.
4.1 By using the Job Board, you agree to collect, store, and process your personal information as outlined in GuardPass's Privacy Policy. GuardPass will handle personal information in accordance with applicable data protection laws.
4.2 You acknowledge and agree that GuardPass may use aggregated, anonymised data for analytical and statistical purposes without identifying individual users or disclosing personally identifiable information.
5.1 GuardPass strives to provide accurate and reliable information on the Job Board, but makes no representations or warranties regarding the accuracy, completeness, or reliability of any content or information on the Job Board.
5.2 GuardPass shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Job Board, including but not limited to errors, omissions, interruptions, or loss of data.
5.3 GuardPass shall not be held liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with the usage of the purchased Credits on the GuardPass job board.
6.1 By placing an order either online on the GuardPass website or through an electronic signed quote with the GuardPass sales representative, you will be agreeing to a fixed term contract
6.2 Each advertisement placed on the Job Board is for a single location and vacancy. Multiple job roles will require multiple job ads.
6.3 Prices and quantities of credits purchased for either job advertising or Profile database are as agreed on the order form. Prices for advertising are exclusive of VAT and are payable by the terms outset in the Order Form. The Buyer agrees to pay the total amount as set on the order form within the specified timeframe as set out in the order form. GuardPass may take appropriate actions, including suspension of services, in the event of non-payment or late payment.
6.4 Jobs advertised on the Job Board must be for genuine vacancies only. It is prohibited to advertise for goods or services.
6.5 The advert copy must not contain contact information such as email addresses, web addresses or telephone numbers.
6.6 We reserve the right to amend any advertisement for clarity or to improve the candidate experience, this may include the structure and format of the advertisement.
6.7 The Job Board cannot guarantee that candidates will apply, nor that they will attend interviews etc. It is the responsibility of the Job Board to advertise the vacancy, not to fill it.
6.8 Advertisements will be live for a duration of 28 days from the date that they are posted. You may pause the advertisement from being live, but it will still expire 28 days after the date of posting. You may close the advertisement prior to the end of the 28-day listing.
6.9 Applications and application information will be removed from the portal for a particular vacancy 28 days after the advertisement has expired. We reserve the right to delete application data earlier than this, including if a candidate exercises their right to be forgotten
6.10 You may edit the advertisement, however, editing is limited in that you may not alter the location of the advertisement. If you need to change the location, this will be deemed a separate vacancy, and a separate ad will be required to advertise any subsequent vacancies
6.11 Upon receipt of a signed contract and, in the case of prepayment Payment Terms receipt of payment, GuardPass will deliver the purchased Credits to the Buyer's designated account or provide instructions for the activation and usage of the Credits on the GuardPass job board.
6.12 The Buyer acknowledges that the Credits purchased under this Contract are valid for a specific duration, as specified in the separate order or agreement, and shall expire after that period. The Buyer agrees to utilise the Credits within the specified validity period and understands that any unused Credits shall not be refunded or carried over beyond the expiry date.
6.13 GuardPass have the right to use customer logos in promotional material.
6.14 Customers agree to give one written testimonial within 8 weeks of signup.
7.1 The candidate profile search may only be used to contact candidates to discuss an active vacancy
7.2 You may not download or copy candidate profiles to create your own database
7.3 You may not share or supply the contents of the database to any third party, including to companies within the same group of companies.
8.1 The Parties agree to maintain the confidentiality of any confidential or proprietary information disclosed during the course of the Contract.
